Terms of Service

By creating an account, placing an order, or otherwise using the SexyMeals website or services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

SexyMeals (“we,” “us,” or “our”) reserves the right to update these Terms at any time. Continued use after changes are posted constitutes acceptance of the revised Terms.

You must be at least 18 years of age and capable of forming a legally binding contract to use the Service. By using the Service you represent that you meet these requirements. Accounts are non-transferable and personal to the registered user.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access. We are not liable for losses resulting from unauthorized use of your account.

• Pricing. Prices are displayed at checkout in US dollars and are subject to change. Any price changes will not affect orders already confirmed.
• Payment. Payment is collected at the time of order placement. We accept major credit and debit cards. All transactions are encrypted and processed through a PCI-compliant payment processor; SexyMeals does not store full card numbers.
• Order confirmation. You will receive an email confirmation after a successful order. That confirmation constitutes acceptance of your order.
• Minimums. We reserve the right to set minimum order quantities or values. Any applicable minimums will be displayed before checkout.

• Cancellation window. Orders may be cancelled or modified up to 48 hours before the scheduled delivery date for a full refund.
• Late cancellations. Cancellations made within 48 hours of delivery may be subject to a cancellation fee of up to 50% of the order value, as meal preparation will already be underway.
• How to cancel. Log in to your account, navigate to Orders, and select the relevant order to request a cancellation, or email us at [email protected].
• Refunds. Approved refunds will be credited to the original payment method within 5–10 business days.

• Delivery area. We currently deliver within our designated service area. Delivery zones are displayed at checkout.
• Delivery windows. You will select a preferred delivery window at checkout. We will make reasonable efforts to deliver within that window but do not guarantee exact delivery times due to traffic, weather, or other factors outside our control.
• Failed delivery. If no one is available to receive the order and no safe-drop instructions were provided, the driver may leave the order at the door at our sole discretion. SexyMeals is not responsible for spoilage or theft once a delivery is marked complete.
• Damaged or incorrect orders. Please report any issue within 24 hours of delivery by emailing [email protected] with your order number. We will investigate and, at our discretion, issue a credit or replacement.

Our meals are prepared in a commercial kitchen that handles common allergens including tree nuts, peanuts, shellfish, fish, wheat, dairy, eggs, soy, and sesame. We cannot guarantee that any meal is entirely free from cross-contact, even when items are omitted from a dish. If you have a severe food allergy or anaphylactic risk, please consult your physician before ordering. SexyMeals is not liable for allergic reactions resulting from undisclosed allergens or cross-contact.

Meals are refrigerated and should be kept refrigerated upon receipt. Follow heating instructions provided with each meal. Consume within the use-by date printed on the packaging. SexyMeals is not responsible for illness resulting from improper storage or handling after delivery.

Dietary preference selections (vegan, gluten-free, halal, etc.) and allergy flags you set in your account are used to highlight relevant meals and filter options. They are not a guarantee of suitability for any medical or religious requirement. Always review the full ingredient list for each meal.

All content on the Service — including recipes, photographs, branding, and text — is the property of SexyMeals or its licensors and is protected by applicable intellectual property law. You may not copy, reproduce, distribute, or create derivative works without our express written consent.

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Service or its systems.
• Submit false reviews, fraudulent orders, or impersonate any person or entity.
• Scrape, crawl, or systematically extract data from the Service.
• Interfere with the proper functioning of the Service.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses.

To the maximum extent permitted by law, SexyMeals and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid for the order giving rise to the claim, or $100, whichever is greater.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-law provisions. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction of such courts.

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to SexyMeals, other users, or third parties. You may delete your account at any time by contacting [email protected].
